Rules for Student Conduct
Building Rules
Each building principal and each individual teacher may establish appropriate rules and procedures for their particular circumstances. However in no case shall class rules supercede building rules. Such rules should stress courtesy, safety, responsibility, honesty and respect for others.
Building rules may be listed in student/parent handbooks
Pupils must comply with school rules as established in ORS 339.250.
District Rules
The following misconduct shall be considered serious rule violations and may lead to suspension and/or expulsion in addition to regular school discipline:
1. Disruption of school – Conduct that is likely to or substantially disrupt a school function. This includes any behavior that could be termed disorderly conduct.
2. Damage or destruction of school or public and/or private property – Conduct that causes or attempts to cause damage to public and/or private property.
3. Theft – Stealing or attempting to steal personal or public property.
4. Assault and/or threats of assault including menacing – Any physical attack on another person or attempt or threat to do so. This also includes attacks with implements, weapons or any device used in an offensive manner.
5. Possession of weapons or replicas of weapons – Excluding firearms (as described in this administrative regulation), possession of any device or replica of such device that was designed or has the capability of being used to disable or harm another person. Examples include but are not limited to, nun-chaku sticks, chemical sprays, knives, etc.
6. Alcohol, tobacco, drugs or other intoxicants – Possession, use, sale or furnishing of tobacco, alcohol, controlled substances or any other substance with the potential for causing intoxication or chemical addiction, is prohibited. Any "attempt" to engage in said conduct is also prohibited.
7. Serious defiance – Either prolonged defiant behavior or a blatant incident of defiance may be considered serious defiance. Repeated failure to follow the most basic instructions or requests may be eventually considered serious defiance.
8. Endangerment of others– Any action or conduct which is likely to or endangers the health and/or safety of the individual or others. Such conduct includes failure to report to the building principal or vice-principal that another student has been seen on school premises or at school functions with a gun or other dangerous or deadly weapon, or replica of any of the above.
9. Personal harassment of others – Harassment includes, but is not limited to, any act which subjects an individual or group to unwanted, abusive behavior of a nonverbal, verbal, written or physical nature on the basis of age, race, religion, ethnicity, national origin, disability or marital status.
10. Criminal conduct – Any action or conduct which, would constitute a criminal offense under the laws of the State of Oregon.
11. Out of School Conduct - Students whose actions violate any Code of Conduct provisions in a setting outside of school are also subject to disciplinary action up to and including expulsion, if their actions can reasonably be anticipated to substantially disrupts or materially interfere with the operation of the schools or to intrude upon the rights of others.
The following misconduct shall result in expulsion from school for one calendar year:
1. Possession, concealing or using of a firearm, dangerous weapon or deadly weapon – Possession, concealing or using of a "firearm", a "dangerous weapon" or "deadly weapon", as those terms are defined hereafter, while on school grounds or attending any school sponsored activity except as specifically approved by the administration;
2. Bringing firearms, dangerous weapons or deadly weapons to school – Bringing any "firearm", "dangerous weapon" or "deadly weapon", as those terms are defined hereinafter, to school, whether or not the firearm or weapon is in the actual physical possession of the student.
The superintendent may, on a case-by-case basis, modify this expulsion requirement unless the expulsion is mandated by the federal law..
Definitions:
"Firearm": for the purposes of these rules, the term "firearm", has the same meaning defined in Section 921 of Title 18 of the United States Code, and in policy JFCJ:
The terms "dangerous weapon", deadly weapon", "firearm" and "destructive device" for this administrative regulation are defined in policy JFCJ:
Miscellaneous Provisions
The rules listed in policy JFC and this administrative regulation are applicable during school, in transit to and from school activities, at school events at any time on or off school property. The violation of "Rules of Student Conduct" policy JFC may result in suspension from the student’s extra-curricular or athletic activities.
All staff members have authority over students during school, in transit to or from school activities, at school events and at any time on and off school property.
Special rules for conduct are posted in school buses and vans. Copies will be distributed by student/parent handbooks to students during the first week they are transported.
Student drivers will obey all posted regulations on school property.
