Use of Outside Resources During School Time
Requests from political, religious, social or educational agencies outside the school to make presentations to students during the school day may be considered when all the following conditions are met:
1. The teacher, department head, and principal involved receive assurance that the presentation is appropriate with regard to timeliness, grade level and curriculum content.
2. The teacher, department head and principal involved receive assurance that the presentation will be identified as a particular point-of-view.
3. A parent who can show he/she would be offended may request their child be excused from an outside resource presentation and be given an alternate educational assignment.
4. The teacher, department head and principal involved can assure students that opposing or contrasting views will have equal opportunity to make presentations.
5. Meeting the conditions stated above shall not be construed to constitute automatic approval. School personnel reserve the authority to grant or deny a request after the above conditions are met.
Grounds for appeal:
1. A building level decision to deny a request for an outside resource presentation may be appealed to the district Director of Curriculum based on grounds that there is demonstrable evidence of bias, discrimination, or arbitrariness in the decision to reject the request.
2. An appeal may also be based on grounds that recommend addition or deletion to the established curriculum.
3. A level one appeal based on grounds stated in #1 and #2 may be made in writing to the district Director of Curriculum.
a. The written appeal must be received by the Director of Curriculum within 10 days of the ruling of the building personnel being appealed.
b. The written appeal must contain documented evidence and a brief argument showing that bias, discrimination or arbitrariness influenced the decision being appealed, or that the subject matter should be added or deleted from the existing curriculum.
4. The district Director of Curriculum may uphold the decision being appealed or reverse the decision with instructions to the building personnel after reviewing the written appeal, and investigated the facts surrounding the decision being appealed. The Director of Curriculum will include in their file a written memorandum of any additional information he secured.
The district Director of Curriculum will within 10 days after receipt of an appeal notify the party making the appeal and the school personnel involved in the ruling of their decision in writing.
5. A level two appeal based on the grounds that procedure or policy were not followed may be made by the school personnel or the requesting party to the superintendent within five days of the Curriculum Director’s decision.
a. The level two appeal must be made by a notice in writing identifying the issues for appeal.
b. The superintendent will render a decision based on the entire written record as compiled by the Director of Curriculum and furnished to the superintendent . If requested in the notice of appeal, the superintendent will take such additional relevant evidence as the appealing party wishes to present. All interested parties must be allowed to be present at any hearing and testify when additional evidence is presented.
c. The district superintendent will within 10 days after receipt of an appeal notify the party making the appeal and the school personnel involved in the ruling of their decision in writing.
d. The district superintendent may uphold the decision being appealed or reverse the decision with instructions to the building personnel after reviewing the written appeal, and investigated the facts surrounding the decision being appealed. The superintendent will include in their file a written memorandum of any additional information he secured.
6. A level three appeal based on the grounds that procedure or policy were not followed at the two appeal and dissatisfaction with the level two decision may be made by the school personnel or the requesting party to the Board within five days of the superintendent’s decision.
a. The level three appeal must be made by a notice in writing identifying the issues for appeal. and also by appearance at a regular Board meeting if requested by the appellant, by school personnel or by the Board.
b. The Board will render a decision based on the entire written record as compiled by the superintendent and furnished to the Board. If requested in the notice of appeal, the Board will take such additional relevant evidence as the appealing party wishes to present. All interested parties must be allowed to be present at any hearing and testify when additional evidence is presented.
c. The Board will hold said hearing in an informal manner. A copy of the Board decision shall be sent to the complainant within 10 days of the meeting.
d. The decision of the Board shall be final.
